ORDINANCE NO. 2002 -7

 

AN ORDINANCE ESTABLISHING A NOTIFICATION SYSTEM FOR CONTROLLED BURNS

 

BE IT ORDAINED by the Hughes County Commission that the following notification process be followed by any entity or individual initiating a controlled burn:

 

SECTION 1:

 

The Pierre Police Dispatch Center shall be notified before a controlled burn is conducted in Hughes County, specifying the date, time and place of the controlled burn.  The Pierre Police Dispatch Center shall also be notified when the controlled burn is completed.

 

SECTION 2:

 

Violations of this ordinance shall be subject to penalties pursuant to SDCL 7-18A-2, specifying a fine not to exceed two hundred dollars for each violation, or by imprisonment for a period not to exceed thirty days for each violation, or by both the fine and imprisonment; and an action for civil injunctive relief, pursuant to SDCL 21-8.

 

SECTION 3:

 

All ordinances or parts thereof in conflict herewith are hereby repealed.
